FAQ

I will create the following subjects:

  • Animated content

    • Including, but not limited to:

      • Fully animated spots

      • Motion graphics

      • Motion comics

      • Animated portraits

      • Streaming content (i.e. animated backgrounds, stream alerts, stingers, overlay elements etc.)

  • Portraits of real people from photo reference

  • Portraits of pets from photo reference

  • Original Characters, either with visual reference or by description

  • Paper carvings

  • Fanart

  • Ships/couples

  • Furry/anthropomorphic characters

  • Suggestive/adult themes of characters over 18

  • Minor gore (i.e. blood, cuts, bruises, bandages)

I will not create the following subjects:

  • Hardcore fetish content (i.e. scat, non-con, explicit gore)

  • Lolicon, or any content that sexualizes minors

    I reserve the right to accept or refuse commissions at my sole discretion.

AGREEMENT

By agreeing to these terms of service, the client agrees to the following:

  • Clients MUST be 18 years or older to agree to these terms.

  • Clients DO NOT have the right to mint/sell their commissions as NFT nor use the art for generative AI purposes. Doing so violates these terms.

  • Clients may not copy or trace my work in any way, unless given express permission in writing.

  • Clients may edit their commissioned works in minor ways, such as use in Profile Pictures, Social Media Banners, or YouTube Thumbnails and similar cases.

  • Clients will credit Madison for the work when reposting commissioned work.

  • Clients may produce physical reproductions of their work for PERSONAL use only. (Not for sale or merchandising purposes.)

  • My commissions are for Personal Use only unless otherwise discussed. Up to the extent that these terms outline, you will not profit off my work unless coming to a written agreement with me beforehand.

  • I retain the copyright to all work I produce. This includes use of the work for self-promotion, as example work in sales of commissions, the right to redistribute, and the right to reproduce the work, unless an agreement is made stating otherwise. For commissions that are public (no limitations stated on posting the work) I may post these works to my other social media platforms with proper credit to the client for ownership of the subject’s image, character’s design, or otherwise copyrighted material.

The Client agrees to provide Madison with the following necessary information:

  • Payment Email required for receiving invoice.

  • Any references, information, or assets necessary to completion of the project.

  • Delivery specifications when applicable (i.e. preferred file type, size, format, intended use).

  • Social Media Handles for proper crediting of commissioned work (if applicable).

  • Preferred Name and Pronouns in the case of long term projects that may require months of communication.

PROJECT

  • Madison reserves the right to refuse any project.

  • Madison reserves the right to cancel any ongoing project if necessary. (See REFUNDS AND DELIVERY for more information.)

  • Projects are only officially accepted once an invoice has been issued and the full amount of less than $250 USD has been paid OR the 1st payment of the agreed upon payment plan is paid.

  • The Client must provide necessary information, such as logos, character references, pose or composition references, and any other information they deem necessary in order for Madison to begin work. Failing to provide necessary information may cause delay to the delivery of the commission.

PAYMENT

  • I will not begin work on a commission until full payment is received OR 1st payment of an agreed upon payment plan is received. Payment plans are only accepted for commissions exceeding $250 USD.

  • Payment will be sent through Invoices only. Prices are listed in USD.

  • Prices listed are a baseline and can fluctuate above the list price based on complexity.

  • Additional fees may apply depending on what the work is intended to be used for. Please see section USAGE AND NDA for more information.

  • Accepted payment methods: Stripe. Any other payment methods will be considered on a case-by-case basis.

PROCESS

  • Submitted commission/project proposals will receive a response within one week.

  • Expect a turnaround time of 1 - 6 months depending on the scope of the project. Individual illustrations/portraits, small paper carvings, or simple, short animations may take 1-2 months, while larger projects such as complex animations, large paper carvings, and large illustrations/portraits are likely to take 3-6 months. This range can vary based on complexity of the order, so please plan accordingly. Generally a sketch and a proposed production schedule/delivery date will be provided within the first month after initial payment is received.

  • For all commission types you will receive a sketch for initial approval. If you must request changes I ask you to do it at this phase.

  • Clients are entitled to three rounds of revisions. Any additional revisions may incur additional fees.

  • Changes requested after the sketch/animatic phase will incur additional fees.

  • In cases where there are small things I have missed, I will change them with no additional charge. (i.e. a missing accessory or incorrect color.) This term is for digital work only, and does not apply to traditional media works.

  • Clients understand that pricing for traditional works does not include matting or framing.

  • For small projects I generally will not send work-in-progress shots after the sketch phase unless requested, so please feel free to ask!

  • Completed digital commissions will be sent in their full resolution and requested formats via Google Drive link unless otherwise specified. In the case of payment plans: Completed commission files will only be sent after the final payment on the invoice is fulfilled.

  • Completed traditional commissions that have opted for shipping will be sent their artwork via either UPS or FedEx with tracking and insurance. In the case of payment plans: Completed commissions will only be shipped after the final payment on the invoice is fulfilled.

  • International shipping for traditional commissions will be accepted on a case-by-case basis.

REFUNDS & DELIVERY

  • Full refunds may occur if a commission has been canceled before Madison has started work.

  • If the commission process has already started, a partial refund may be available depending on the completion status of the project.

  • The client must communicate any necessary deadlines or delivery dates in their proposal. Madison will confirm a delivery schedule with the Client before accepting payment. Changes to established schedules may incur additional fees.

  • Partial refunds may be available if Madison has failed to deliver a commission in a reasonable, timely manner. (Exceeding 6 months with no communication.) Some leniency is allowed as long as delays in expected project timeline are clearly communicated with the Client.

  • Delivery of a project (project files and/or physical artwork) may be withheld if payment from Client is not fulfilled at the time Madison has completed the work.

USAGE & NDA

All commissions are for PERSONAL USE ONLY.

The Client may request additional usage rights for the commissioned work during the ordering process. I consider the following use cases as commercial use:

  • Reproduction of the work, publicly or privately, in which you will receive profit from my work.

The fee incurred by commercial usage rights is broken into the following tiers:

  • 1) +25% - Youtube, Twitch, Twitter, Social Media promotional material (Use in Digital monetized content. – Ex. Overlays, Thumbnails, and other directly monetized content.)

  • 2) +100% - Reproduction, Selling, Merch (Use in merchandise for sale. – Ex. Art Prints, apparel designs, charms or keychain designs.)

This fee is subject to increase at the scope of the project, such as applying to groups, businesses, and corporations.

A Client may request for their project to remain private during the ordering process. This means Madison will not stream work of, post WIPs of, or post completed versions of the project until an agreed upon date in the future.

  • This privacy fee is +20% of the total price of the commission.
